URGENT: Parent Caregivers — We Need Written Public Comment

The Medical Services Board is voting on rule changes that cut hours for parent caregivers. Written testimony is critical right now.

Please consider submitting a comment and SHARING what’s true for your family:


  • There is a severe lack of providers in rural areas — parent caregivers are often the only providers available


  • Homemaker 5 hour caps, penalize single parent households. If two Legally Responsible people can provide 5 hours of homemaker services each, one parent shouldbe allowed to provide 10 hours.
     
  • Even in Grand Junction, PASAs and agencies do not have enough staff to meet families’ direct care needs
     
  • Many agencies are not trained or equipped to support our children’s unique disabilities and complex behaviors
     
  • No agency has sufficient staff to replace the care families are already providing
     
  • Even families approved for respite cannot access it because providers do not exist
     
  • Cutting caregiver hours removes care — it does not replace it

Major Reduction for Legally Responsible Parents

This rule specifically, the rule states that:

  • Legally Responsible Persons providing over 5 hours of Homemaker per member per week will experience a reduction in working hours
     
  • This limit is part of HCPF’s cost-containment strategy and applies even when no alternative providers are available

This confirms that the rule does directly impose a 5-hour weekly cap on LRP Homemaker services and is a key component of the proposed savings.

Community Connector restricted to age 6+

Community Connector would be limited to “school-aged (6 and older)” children only 

  • Children ages 0–5 would lose access, even if medically or developmentally necessary  
  • This impacts families using Community Connector to:  
    • Practice safety and community skills  
    • Support preschool and kindergarten readiness  
    • Generalize therapy goals outside the home

New hard limits on paid caregiver hours

Across all HCBS and CFC services combined, caregivers would be limited to:

  • No more than 16 hours per day
  • No more than 56 hours per week per member
  • Applies across:
    • Personal Care
    • Homemaker
    • Health Maintenance Activities
    • CDASS
    • IHSS
    • Private Duty Nursing
    • Long-Term Home Health

Expanded enforcement, audits,and payment holds

  • New enforcement section allows:  
    • Payment holds  
    • Recoupments  
    • Plans of correction  
    • Penalties for exceeding limits (even unintentionally)  
  • Agencies and caregivers must submit detailed attestations and records
